The first question made in the case is upon the ruling of the court, that' the testimony of Henry Baker was inadmissible. The parties were at issue upon the question of fact, whether at the time of bringing suit the plaintiff was abandoned by' her husband, so that by virtue of the statute of 1853 she could sue alone as a feme sole.
