V. C. Collins brought suit in two counts against R. L. Kytle, as executor under the will of Calvin Kytle, and individually, and against S. C. Moon and J. E. Davis, the petition as amended alleging in count 1 as follows: Previously to and on February 24, 1934, the defendant Kytle had in his control and for sale as executor under the will of Calvin Kytle, his father, a tract of land located in White County and known as the Calvin Kytle farm.
