On December 19, 1989, Charles Quinlyn Fortner was convicted of first-degree sodomy. On January 3, 1990, the trial court sentenced him to 25 years in prison. Fortner appealed, and this Court affirmed his conviction. Fortner v. State, 582 So.2d 581 (Ala.Crim.App. 1990). This Court issued the certificate of judgment on May 17, 1991. On April 8, 1993, Fortner filed his first Rule 32, Ala.R.Crim.P., petition, which the circuit court summarily denied. This court affirmed the circuit court's denial in an unpublished memorandum.
