— Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Comptroller which denied petitioner an accidental disability retirement allowance. On December 15, 1966, petitioner, a police officer employed by the City of Lockport, suffered a heart attack after having run a total of several hundred yards, while wearing a heavy coat and golashes, in pursuit of some youths who had been creating disturbances.
