Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Comptroller which denied petitioner’s application for accidental disability retirement. Petitioner was a member of the Ithaca Police Department when, on October 16, 1969, he suffered a myocardial infarction. Thereafter, he did not resume his duties with the police force until August 17, 1970, and then approximately two months later, on October 14, 1970, he was admitted to the hospital with unstable angina.
