The plaintiff commenced this action3 against *588Commercial Union Insurance Company (Commercial Union), Merchants Mutual Insurance Company, also known as Merchants Insurance Group (Merchants), and several other insurance companies,4 seeking a declaration that the general liability insurance policies issued by those insurers obligated them to defend and indemnify the plaintiff in any environmental liability suit brought against the plaintiff, either by a third party or the Department of Environmental Protection (DEP).5 We hold that the plaintiff is not entitled to such coverage due to the…
