The plaintiffs in error, Harry Weston, John Davis and Louis Simpson, were found guilty in the circuit court of Eranklin county upon an indictment charging them with rape upon the person of Eliza Eason and were each sentenced to a term of twelve years in the penitentiary. Error has been assigned on the denial of their application for a change of venue and their motion for a continuance, but these errors cannot be sustained because the action of the court has not been preserved for review.
