CEDARBAUM, District Judge.
Johnny Hincapié petitions for a writ of habeas corpus to vacate the judgment of conviction and sentence entered by Justice Edwin Torres on January 3, 1992 in New York State Supreme Court, New York County. On December 10, 1991, after a seven week trial, a jury convicted petitioner of murder in the second degree, two counts of robbery in the first degree, and two counts of robbery in the second degree.
