The action, tried by stipulation before the court, is brought to recover damages for breach of a covenant for restoration in a written lease dated October 20, 1925, between the plaintiff as landlord and one Palumbo as tenant covering the premises 182 Graham avenue, borough of Brooklyn, New York city.
