MEMORANDUM OF DECISION
ZAMPANO, District Judge.
Gregory A. Johnson, an enlistee and Electronics Technician third class in the United States Navy, seeks habeas release from military service on the ground that he is a conscientious objector. His initial petition *12was filed on November 13, 1975, following notice from the Chief of Naval Personnel that his application for a discharge had been denied. At that time, the Court remanded petitioner’s case to the Department of the Navy for further action and retained jurisdiction of the case.
