DECISION

ORSER, Judge:

Tried by a special court-martial with members, the accused was convicted, pursuant to his plea, of one offense of larceny and, contrary to his plea, of an offense of willful and wrongful damage to private property, in violation of Articles 121 and 109, 10 U.S.C. §§ 921 and 909, Uniform Code of Military Justice. The supervisory authority disapproved the latter finding of guilty on the basis of advice from his staff judge advocate that the Government’s evidence was insufficient to establish the accused had been properly warned prior to admission in evidence of his pretrial…
