OPINION
HAMILTON, Circuit Judge:
The issue in this case is whether we have jurisdiction to hear the appeal of a grant of summary judgment in favor of a defendant on the basis of qualified immunity, where claims remain pending in the district court. Concluding that we lack jurisdiction in such circumstances, we dismiss the appeal.
