MEMORANDUM ON WAIVER OF DEFENSE OF INSUFFICIENT SERVICE OF PROCESS

This adversary proceeding is before the court upon the “Complaint” filed by the Plaintiff, pro se, objecting to the discharge-ability of a debt owed to him by the Defen-dani/Debtor (Defendant). On August 26, 2004, the Defendant, by and through counsel, filed a Motion to Dismiss Adversary Proceeding (Motion to Dismiss), along with a Brief in Support of Motion to Dismiss Adversary Proceeding.
