The appellant was indicted by the Grand Jury of Lafayette County, Mississippi for the murder of Mathis Jones. She was found guilty of manslaughter and sentenced to serve eleven years in the state penitentiary.

Several assignments of error were filed. The Court will consider these two: First, the court erred in admitting into evidence as a dying declaration a statement made by Mathis Jones, the deceased, to the witness, Boyce Bratton, Sheriff of Lafayette County; and second, the court erred in failing to grant defendant’s motion for a directed verdict of not guilty.
