1. This is a suit to have a deed absolute on its face declared to be a mortgage and to redeem therefrom. Prior to the 10th day of December, 1901, plaintiff had negotiated for the purchase of a portion of lot 3 of section 22,. township 25 S., range 13 W., W. M., in Coos County, Oregon, from Mrs. Schetter, residing in San Francisco, for the price of $750, and had by wire directed her to forward to him at Marshfield, Oregon, a deed therefor.
