Robert W. Tiff, defendant and appellant herein, was charged in the District Court for Lancaster County with sexual assault in the first degree under section 28-408.03, R. R. S. 1943; and with being an habitual criminal under section 29-2221, R. R. S. 1943. Defendant filed a plea in abatement and moved to dismiss the charges on the ground that the District Court for Lancaster County had no jurisdiction because the alleged sexual assault allegedly took place in Gage, rather than Lancaster, County.
