This is an appeal from an Order of the Court of Common Pleas of Delaware County granting judgment *63on the pleadings in favor of the Pennsylvania Department of Transportation, the appellee.

Robert A. Blanchfield and Janet A. Blanchfield, the appellants, were involved in a two car accident with Edna Escher on a highway maintained by DOT. Appellants signed a release which was given to Edna Escher and her husband, Patrick, in return for $50,000, the policy limit of the Eschers’ insurance.
