This is an action in assumpsit to recover installments of rent and taxes in the total amount of $2935.83, allegedly due for the period between September 1940 and March 1941 under a lease of certain premises in the city of Providence. A justice of the superior court, siting without a jury, rendered a decision for the defendant. .The case is before us on plaintiff’s exception to this deci sion and also on certain other exceptions to rulings in the case.
