Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered July 3, 2012, upon a verdict convicting defendant of the crime of criminal sexual act in the first degree (two counts).
Defendant was charged by indictment with two counts of criminal sexual act in the first degree and one count of attempted rape in the first degree, stemming from allegations that he sexually assaulted the victim in the Town of Union, Broome County.
