ALARCÓN, Circuit Judge:
Robert F. Hinely, Jr., (“Hinely”) appeals from an order of summary judgment in favor of his former employer, Alliance Metals, Inc., of Atlanta (“Alliance Atlanta”), in an action Alliance Atlanta brought against Hinely for breach of his employment contract and trademark infringement. We have jurisdiction under 28 U.S.C. § 1291. We review the district court’s grant of summary judgment de novo, applying the same standards used by the district court and viewing the facts in the light most favorable to the nonmoving party.
