Appeal from a judgment of the superior court for King county, Rudkin, J., entered March 11, 1904, upon withdrawing the ease from the jury, at the 'dose of plaintiffs evidence, in an action to compel the state dental board to issue a. license to practice dentistry.

The appellant filed, in the superior court of King county, án affidavit and petition for a writ of mandamus, to be issued against the board of dental examiners of the state of Washington, and the members -thereof, commanding them to issue to appellant a license to practice dentistry in the state of Washington, alleging in the petition that they had refused to grant the same to appellant unless he would sign a certain code of ethics which had been prepared by the said board of dental examiners, and alleging that he was qualified for admission, etc. The respondents answered, denying the…
