This cause comes into this court on a petition in error to the municipal court of the city of Cleveland, the purpose being to reverse a judgment of the municipal court in' sustaining a demurrer to a petition filed by the Ukrainian American Building & Loan Association, plaintiff below, asking for a new trial in the trial court on the ground of newly discovered evidence, in a case that had been tried and judgment rendered more, than a year prior to that time.
