The first assignment of error was that the court erred in permitting the state to introduce the photograph of deceased. The photograph was taken about two days after the death of deceased. There was a controversy between the state and the defendant as to whether an eye of the deceased, which was black, had been caused by the fluid used by the undertaker when the body was embalmed, or by the defendant striking her at the time of her death.
