OPINION
STERN, District Judge.
In this “citizens’ suit”, brought pursuant to section 505 of the Federal Water Pollution Control Act (the Act), 33 U.S.C. § 1365 (1976), 1 plaintiffs Student Public Interest Research Group of New Jersey, Inc. and Friends of the Earth seek declaratory and injunctive relief, as well as the imposition of civil penalties, costs and fees, as a result of alleged violations by defendant Fritzsche, Dodge & Olcott, Inc.
