These consolidated matters concern a partition by licitation of mineral interests owned by the parties. The Bel Mineral case presents the question of whether the parties hold interests in common giving rise to the right of partition. On consideration of a motion for partial summary judgment, the trial court concluded that interests are held in common, namely the right to explore for, develop and reduce to possession and ownership the minerals in and under the parties’ ancestral property.
