Pro se petitioner Stephen Moss (“Moss”), an inmate in the custody of the Federal Bureau of Prisons (“BOP”) at the Federal Correctional Institution in Otis-ville, New York (“FCI Otisville”), seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2241, alleging that the BOP policy regulating the availability of inmate placement in a community corrections center (“CCC”) (1) violates the notice and comment requirements of the Administrative Procedure Act (“APA”); (2) is based on an erroneous interpretation of 18 U.S.C. § 3621(b); and (3) as applied to him,…
