Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Washington County) to review a determination of the Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

Petitioner was found to have violated prison rule 104.10 (rioting) and received a disciplinary penalty of one year in the special housing unit with a loss of privileges and a recommended one-year loss of good time.1 The prison disturbance occurred on May 26, 1990 at Attica Correctional Facility in Wyoming County.
