Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme *877Court, entered in Ulster County) to review a determination of the Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

In February 1990, petitioner, then an inmate at Sing Sing Correctional Facility in Westchester County, was involved in an incident which resulted in his being charged with assaulting two correction officers.
