James Leroy Sims was acquitted on two counts of second degree assault. Nevertheless, he appeals the trial court’s failure to give a self-defense instruction. He claims that this alleged error deprived him of reimbursement for his costs and legal fees as authorized under RCW 9A.16.110.1 He requests that a new jury be impaneled solely *127to determine his right to compensation based on his claim of self-defense.
