Appellant Wesley J. Umpleby (“Umple-by”) appeals from a judgment entered December 20, 1985 in the District of North Dakota, Bruce M. Van Sickle, District Judge, which granted summary judgment in favor of appellee, United States of America, acting by the United States Army Corps of Engineers (“the Corps”) in an action pursuant to the Federal Tort Claims Act, 28 U.S.C. § 2671 et seq.
