GOTTSCHALL, District Judge.
Plaintiff, Robert O’Brien, has filed a class action lawsuit against defendants, Encotech Construction Services, Inc. (“Encotech”) and Howard Frank, Encotech’s owner. In his four-count complaint, O’Brien alleges that he and a class of Encotech employees were not compensated for all the hours they worked and not compensated at the overtime rate for all hours worked in excess of forty hours per week.
