This action concerns the rights of a national bank to sell insurance under 12 U.S.C. § 92, which permits banks in towns with populations under 5000 (“places under 5000”) to act as insurance agents. Plaintiff Shawmut Bank brought this suit for declaratory and injunctive relief to prevent the defendant insurance commissioner Robert M.
