This is a proceeding in error brought to review the action of the district court of Douglas county in setting aside a judgment rendered in favor of the plaintiff and in refusing to set aside a verdict subsequently returned in favor of the defendant. This is the second appearance of the case in this court. When it was here before a judgment in favor of the defendant was reversed for want of sufficient evidence to support it, and the cause remanded for further proceedings. (Bradley v.
