This suit originated in the circuit court of Lawrence county, by the appellant filing with the clerk of said court on August 30, 1909, a petition and affidavit in replevin in due form', wherein it was claimed that appellant was the owner and entitled to the possession of ten top buggies and six surreys, of the value of twelve hundred dollars. The suit was brought to the January term, 1910, of said court.
