Six separate appeals by different defendants, one from the whole and five from various parts of a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Rew York on the 3d day of May, 1901, upon the decision of the court rendered after a trial at the Rew York Special Term.

Laughlin, J.:

This action was commenced on the 27th day of May, 1899, by the Farmers’ Loan and Trust Company for a judicial settlement of its accounts as trustee under the will of James S. Gibbes, Sr., and to obtain a construction of certain provisions of the will. The testator was a resident of Charleston, S. C., and died in that city on the 26th day of April, 1888. His will with codicils annexed was duly .admitted to probate by the Probate Court of the county of Charleston on the 1st day of May, 1888.
