Richard Alton Williams, the respondent herein, by his complaint, alleges that on June 23, 1960, the Pendleton Manufacturing Company, the appellant herein, caused certain dyes and poisons to be discharged into Three and Twenty Creek located in Anderson County, South Carolina, thereby causing the waters of said creek to become polluted, poisoned and unfit for consumption by cattle.
