In the Circuit Court of Mississippi County appellant was convicted of murder in the first degree and sentenced to life imprisonment for the killing of Elisha (called Lige) P. McCutchan, in said county. We shall refer to appellant as the defendant and to McCutchan as the deceased. The killing occurred on the night of July 3, 1935. That it was murder is clear from the evidence and is not seriously disputed.
