The appellant was convicted in the circuit court of the City of St. Louis of manslaughter for fatally shooting one Samuel Jennings in that city. The cause was submitted to the jury on both second • degree murder and manslaughter. The punishment assessed by the jury was five years imprisonment in the penitentiary.
