This case pends on cross motions for summary judgment. In a conference with the Court on Wednesday, September 15, 1982, the parties agreed to stipulate the material facts and agreed that the issue of liability should be separated under Rule 42(b), Fed. R.Civ.P. and determined by the filing of cross motions for summary judgment under Rule 56, Fed.R.Civ.P.
