Plaintiff Pete Johnson (“claimant”) seeks review of the denial of his application for Disability Insurance Benefits under Title II of the Social Security Act. The sole issue on appeal is a relatively narrow one: Did the administrative law judge (“ALJ”) err when he failed to give controlling weight to claimant’s treating physician and instead credited the assessment of a non-treating state agency physician who concluded that claimant had the capacity to perform a limited range of work?
