This is an action of tort brought by the widow of Joseph L. Donaldson under the St. of 1887, c.'270, § 2, to recover for the death of her husband while in the employ of the defendant as a brakeman. At the close of the plaintiff’s evidence the judge before whom the case was tried in the Superior Court directed a verdict for the defendant, and the case is before us on the plaintiff’s exceptions.
