Appeal from a judgment of the Supreme Court, Erie County (Penny M. Wolfgang, J.), rendered December 22, 2009. The judg*1596ment convicted defendant, upon his plea of guilty, of criminal possession of a weapon in the second degree, criminal possession of a weapon in the third degree, criminal possession of a controlled substance in the fourth degree and unlawful possession of marihuana.
It is hereby ordered that the judgment so appealed from is unanimously affirmed.
