FINAL SUMMARY JUDGMENT IN FAVOR OF SCENIC LANDSCAPING, INC.

THIS MATTER was heard on the Motion of the Defendant, Scenic Landscaping, Inc., (“Scenic”) for Final Summary Judgment. The Court has reviewed the record and heard argument of counsel. Based on the findings of fact and conclusions of law set forth below, the Court finds there is no genuine issue as to any material fact relative to express or *190implied consent and the Defendant, Scenic Landscaping is entitled to Judgment as a matter of law.
