Garrett v. State

Court of Criminal Appeals of Oklahoma

Decided May 31, 1928No. A-6399PublishedCited by 7 opinions

1Opinion of the CourtDoyle, P. J.

The information charges that in Adair county, on or about June 15, 1926, Walter Garrett did have in his possession about one-half gallon of whisky, with the unlawful intent to sell the same. On the trial, the jury returned a verdict finding him guilty and assessing his punishment at imprisonment in the county jail for 30 days and a fine of $50. To reverse the judgment rendered on the verdict, he appeals, and assigns as error the admission of evidence obtained by an unlawful search of his home, admission of incompetent and prejudicial evidence, and refusing to direct a verdict of acquittal.
