In an action to recover damages for false arrest and imprisonment and malicious prosecution, defendants appeal from an order of the Supreme Court, Queens County, dated August 14, 1973 and entered in Kings County on September 5, 1973, which denied their separate motions for summary judgment dismissing the complaint. Order reversed, on the law, without costs, motions granted and complaint dismissed. On October 26, 1970, defendant Sunnyside Savings and Loan Association was held Up and $2,600 was turned over to the robber by codefendant Reynolds (sued herein as Robinson), a teller in the bank.…
