This was an action of trespass to try title brought in the court below by appellee against appellants and others, to recover an undivided half interest in a tract of about four and a half acres of land in the town of Sulphur Springs. The assignments of error all point to the action of the court below in the introduction and rejection of evidence, and will be considered in order. The first assignment is, that “the court below erred in permitting plaintiff to read in evidence, over defendants’ objection, a deed fromO. S. Davis to O. E. Roberts.”
