MEMORANDUM OPINION

CHASANOW, District Judge.

Presently pending and ready for resolution is the motion of Defendant Denny’s, Inc., to dismiss pursuant to Fed.R.Civ.P. 12(b) (6), or, alternatively, for summary judgment pursuant to Fed.R.Civ.P. 56 (paper no. 11). The issues are fully briefed and the court now rules pursuant to Local Rule 105.6, no hearing being deemed necessary. For the reasons that follow, the court grants Defendant’s motion for summary judgment. Furthermore, the claims against Defendant John Doe will be dismissed.
