Pro se petitioner Frank Figueroa (“Figueroa”), currently incarcerated at New York State’s Elmira Correctional Facility, commenced this action against respondent Robert Ercole, superintendent of New York’s Green Haven Correctional Facility (the “Respondent”), where Figueroa was previously incarcerated, seeking a writ of habeas corpus pursuant to 28 U.S.C. § 2254 (the “Petition”).
