This appeal concerns one phase of the lengthy dispute between Frank Aeierno (“Aeierno”) and New Castle County (the “County”) over Acierno’s efforts to develop a 40 acre parcel of land located near the intersection of Interstate Highway 95 and Route 273, in New Castle County (the “273 property”). In 1993, after Aeierno was denied a building permit, he filed an injunctive action in the United States District Court for the District of Delaware, claiming violations of his constitutional rights.
