This is a civil action for assault and battery against 2 police officers commenced more-than 2 years after the alleged assault occurred. Defendants moved below to dismiss on the ground that the action was barred by the 2-year statute of limitations. Plaintiff countered that the statute is no-bar because the defendants fraudulently concealed their identity from him, thus, under a 1954 amendment hereinafter set forth, tolling the statute.
